Terms of Use

ONSE lets you record one short moment — a photo or a video of up to two seconds — for each calendar day, and assembles those moments into short films covering a week, a month, a year, a date range you choose, or a selection of moments you pick. Your moments are uploaded to our cloud storage so that films can be rendered on our servers and so that your timeline is available on your device.

The App requires an account, created with Sign in with Apple or with Google. You are responsible for maintaining control of the account you sign in with and for activity that happens under your account. You must be old enough to form a binding contract in your country of residence to use the App.

You keep all ownership of the photos, videos, and titles you put into ONSE (“Your Content”). You grant us only the limited licence we need to operate the service for you: to store Your Content, to transcode and assemble it into the films you request, and to deliver it back to you. We do not use Your Content to train machine-learning models, we do not sell it, and we do not publish it. That licence ends when you delete the content or your account.

You are responsible for Your Content, including having the right to record and upload it, and the rights of any other person who appears in it. Do not upload content that is unlawful, that infringes someone else’s rights, or that you do not have permission to record.

ONSE offers an optional auto-renewable subscription (“ONSE Premium”) on a monthly or annual term. The price and term are shown in the App before you buy, in your local currency.

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically at the same price and term unless you cancel at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel the subscription at any time in your Apple Account settings. Deleting the App does not cancel the subscription.
• Purchases and refunds are handled by Apple under the Apple Media Services Terms and Conditions. We cannot process refunds ourselves; you can request one from Apple.

If a subscription lapses, you keep access to the moments and films you already have; premium features stop.

Do not attempt to access another user’s data, circumvent the entitlement checks that gate premium features, reverse-engineer the App except to the extent that restriction is unenforceable by law, or interfere with the operation of the service. We may suspend or terminate an account that does.

We may change, suspend, or discontinue any part of the App. We may update these Terms; if a change is material we will make the updated Terms available here before it takes effect, and continuing to use the App after that means you accept them.

You can delete your account from within the App. Deleting the account irreversibly deletes your moments, your rendered films, and your profile from our systems. It does not cancel an active subscription — cancel that separately in your Apple Account settings. See the Privacy Policy for detail.

The App is provided “as is”, without warranties of any kind to the fullest extent permitted by law. ONSE is not a backup service: keep your own copies of anything you cannot afford to lose. To the fullest extent permitted by law, our total liability arising out of or relating to the App is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.

The following apply because the App is distributed through the App Store.

• Acknowledgement. These Terms are between you and FabFun ZZP only, not with Apple. We, not Apple, are solely responsible for the App and its content.
• Scope of licence. We grant you a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support. We are solely responsible for maintenance and support. Apple has no obligation to furnish either.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
• Intellectual property. If a third party claims the App infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms when using the App.
• Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
